This Disclaimer is an integral part of the Public Offer (Agency Agreement) and the Terms of Use of the boostmlbb.ru Service. 1.2. By using the Service, the User confirms that they: - Have fully read and understood this Disclaimer - Understand all the risks associated with using the Service - Accept responsibility for the consequences of their actions - Act voluntarily and in their own interest ## 2\. Nature of the services 2.1. The boostmlbb.ru Service is an information platform (aggregator) providing the technical means of interaction between Customers and Providers of game services in Mobile Legends: Bang Bang. 2.2. **The Operator is NOT:** - The direct provider of game services - An official partner or representative of Moonton Games - A licensed agent for selling game content 2.3. **The Operator acts solely as:** - An information intermediary between the parties - A guarantor of the security of the transaction between the Customer and the Provider - An arbiter in the event of disputes #### Please note Boosting (rank-up) services involve granting access to the game account to a third party, which may violate the rules of Mobile Legends: Bang Bang. ## 3\. Risks of using the service #### Acceptance of risks By using the Service, the Customer (Principal) understands and voluntarily accepts the following risks: ### 3.1. Risks related to the game account - **Account blocking (ban):** The Moonton Games administration may block the account for violating game rules, including transferring the account to third parties - **Temporary restrictions:** Temporary bans, ranked-game restrictions, and rank reductions are possible - **Loss of progress:** As a result of sanctions, achievements, rank, and seasonal rewards may be reset - **Loss of virtual currency:** Diamonds, Battle Points, and other resources may be blocked together with the account ### 3.2. Risks of sharing credentials - **Third-party access:** When the login/password is shared, the Provider gains access to the account - **Human factor:** Despite verification, it is impossible to rule out Provider errors - **Changes to the account:** The Provider may (accidentally or intentionally) change settings or make purchases ### 3.3. Technical risks - **Game server failures:** Maintenance and server outages may interrupt order completion - **Game updates:** Patches and updates may temporarily make the game unavailable - **Internet problems:** Connection failures may affect the result - **Telegram failures:** Unavailability of the messenger may hinder communication ### 3.4. Financial risks - **Loss of funds:** In cases not covered by the refund guarantee - **Inability to refund:** In the event of a breach of terms by the Customer ## 4\. Disclaimer of liability #### The Operator is NOT liable for: ### 4.1. Actions of the game administration The Operator fully disclaims liability for any sanctions applied by the Moonton Games administration to the Customer's account, including but not limited to: - Permanent account ban - Temporary blocking - Rank reset - Functionality restrictions - Confiscation of virtual assets ### 4.2. Technical failures - Failures on Mobile Legends: Bang Bang servers - Maintenance and scheduled game updates - Internet connection problems (on the side of the Customer, Provider, or providers) - DDoS attacks and cyberattacks on game servers - Telegram malfunctions ### 4.3. User actions - Loss of credentials through the Customer's fault - Logging in to the account while the order is in progress - Changing the password/links without warning the Provider - Providing incorrect data - Violation of the game's terms of use before, during, or after the boost - Use of cheats, scripts, or modified clients ### 4.4. Force majeure circumstances - Natural disasters - Military actions - Changes in legislation - Pandemics and their consequences - Decisions of government authorities ### 4.5. Indirect damages - Lost profits - Loss of data - Moral damage - Reputational losses ## 5\. Limitations of liability 5.1. **Maximum liability:** The Operator's total liability to the Customer shall under no circumstances exceed the amount actually paid by the Customer for the specific order. 5.2. **Exclusion of indirect damages:** The Operator is not liable for indirect, incidental, or punitive damages or lost profits, even if warned of the possibility of such damages. 5.3. **Provider's liability:** The Provider is responsible for the quality of the direct performance of game services. The Operator assists in resolving disputes and guarantees refunds under the Refund Policy. 5.4. **The Operator's good faith:** Despite the limitations, the Operator undertakes to act in good faith and make reasonable efforts to protect Customers' interests. ## 6\. What the service guarantees #### Our guarantees The Operator guarantees the following: - **Provider verification:** All Providers undergo a qualification check before being allowed to work - **Refund guarantee:** Refunds in cases provided for by the Refund Policy - **Confidentiality:** Protection of personal data in accordance with FZ-152 - **Technical support:** Review of requests within the set deadlines - **Fair dispute resolution:** Objective arbitration between the Customer and the Provider - **Payment security:** Use of secure data transmission channels ## 7\. What the service does NOT guarantee #### The Operator does NOT guarantee: - **No ban:** It is impossible to guarantee that the account will not be blocked by the game administration - **Retention of rank:** After an order is completed, the rank may change due to the Customer's actions or a seasonal reset - **A specific win rate:** The win rate depends on many factors (opponents, teammates, matchmaking) - **Exact deadlines:** Completion times are approximate and may change - **Uninterrupted operation:** Technical failures and interruptions in the Service are possible - **Compliance with game rules:** Boosting services may violate the Moonton Games ToS ## 8\. User consent 8.1. By using the boostmlbb.ru Service, the User confirms: - Full familiarization with this Disclaimer - Understanding of all the risks associated with using the Service - Voluntary agreement to accept the stated risks - Waiver of claims against the Operator on the grounds stated in the Disclaimer - Being aged 18 or over (or having the consent of parents/guardians) 8.2. If the User disagrees with the provisions of the Disclaimer, they must immediately stop using the Service. #### Legal force This Disclaimer has legal force in accordance with Articles 421 and 428 of the Civil Code of the Russian Federation (freedom of contract, adhesion contract). ## 9\. Applicable law 9.1. This Disclaimer and all relations between the User and the Operator are governed by the legislation of the Russian Federation, in particular: - The Civil Code of the Russian Federation - Federal Law No. 152-FZ "On Personal Data" - The Russian Law "On Consumer Protection" (in the applicable part) 9.2.
